The court confirms the rights of Novell to the Unix operating system

On August 10, 2021, the litigation between Novell and SCO Group ended. Utah Central District Court (USA) found Novell as sole owner of Unix and UnixWare trademarks.

Recall that in March 2021, the SCO Group began a lawsuit against IBM, accusing the corporation of illegally disclosing the source code of the Unix System V operating system to a number of Linux developers, to which the SCO Group allegedly had rights. According to SCO Group representatives, this code was subsequently used in Linux with 2 kernels.4 and up. Based on this, SCO Group demanded compensation in the amount of 5 billion from the defendants. dollars, and offered Linux users to purchase licenses for the operating system.

Novell was embroiled in litigation in January 2021. The fact is that in 1995, an agreement was concluded between Novell and the SCO Group, according to which the latter received the Unix code, but the copyright for it was not transferred. Therefore, Novell continued to build its relationship with customers based on the priority right to the source code. SCO Group attorneys accused Novell of defrauding consumers and spreading false information that Novell is the copyright holder of the Unix System V operating system.

The lengthy litigation yielded a historic ruling that clarifies the tangled relationship between proponents and opponents of open source software. Court recognized Novell as sole owner of Unix and UnixWare trademarks.

In addition, the court ruling denies SCO Group its rights to claims against IBM, Linux and a number of other companies. The court also ordered the SCO Group to pay Novell royalties received from Microsoft and Sun as payment for Unix licenses. Microsoft and Sun donated 16 million to SCO Group in 2021. and 10 million. dollars. Since, according to a court decision, the true owner of the rights to Unix all this time was exactly Novell, SCO Group, upon receipt of license payments, had to make deductions from Novell – in the amount of 95% of the amounts received. Since this condition has not been met, SCO Group is obliged to compensate Novell for the lost income. The exact amount of payments will be established in the course of further court proceedings.
